DMCA Policy
1. Our position on copyright
EpisoShort licenses the series, episodes, artwork, music and subtitles it offers. We do not knowingly publish content that infringes someone else's rights, and we respond to properly documented notices about material on our service.
This policy describes the notice-and-takedown procedure modelled on the U.S. Digital Millennium Copyright Act. If you are outside the United States, you may also have a statutory takedown route in your own jurisdiction, and you can use that instead.
2. Sending a takedown notice
For your notice to be actionable, it must be in writing and include all of the following:
- identification of the copyrighted work you say has been infringed, or, if one notice covers several works, a representative list of them;
- the specific URL, series title, episode number or other information reasonably sufficient for us to locate the material on our service — "somewhere on your app" is not enough;
- your name, mailing address, telephone number and email address;
- a statement that you have a good-faith belief that the use is not authorised by the rights holder, its agent or the law;
- a statement, under penalty of perjury, that the information in your notice is accurate and that you are the rights holder or authorised to act on the rights holder's behalf;
- your physical or electronic signature.
Incomplete notices may be returned for completion rather than acted on, because acting on an uncorroborated claim can harm another creator.
3. Where to send it
Email:
contact@episoshort.cc
Subject line: DMCA Takedown Notice
We review complete notices and take appropriate action, including removing or disabling access to infringing material and notifying the relevant content supplier.
4. Counter-notice
If your material was removed and you believe it was removed by mistake or misidentification, you may send a counter-notice to the same address. It must include:
- identification of the material that was removed and where it appeared;
- a statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification;
- your name, address, telephone number and email address;
- a statement that you consent to the jurisdiction of the Federal District Court for the district where your address is located, or, if outside the United States, any judicial district in which the service provider may be found, and that you will accept service of process from the person who sent the original notice or that person’s agent;
- your physical or electronic signature.
We may forward a complete counter-notice to the original complainant and, where the DMCA procedure applies, restore the material no earlier than 10 and no later than 14 business days after receiving it, unless the complainant notifies us of a court action seeking to restrain the alleged infringement.
5. Repeat infringement
Accounts that repeatedly receive valid infringement notices may have their access to the service suspended or terminated.
6. Misuse of this process
Knowingly making a materially false claim in a notice or counter-notice can expose you to legal liability, including costs and damages. If you are unsure whether material infringes your rights, consider seeking independent legal advice before sending a notice. If the dispute is with another user rather than with EpisoShort, note that we are not a party to it and cannot adjudicate ownership.
